1: General Terms of Hire

All mobile skip bins hired out through “East Coast Skip Bins” are entirely under ownership of the company “East Coast Skip Bins” under no circumstance will the client have any right to claim ownership of any skip bin during or outside of the hire contract.

2: Skip Bin General Information

Each skip bin at “East Coast Skip Bins” is built to Australian standard. Each mobile skip includes a Hydraulic lift. Each bin weighs 880 kg’s and measures 3300 mm (L), 2300 mm (W) & 2000 mm (H).

3: Placement of the Mobile skip trailers during hire contract

Whilst we endeavour to adhere to our customers wishes it is at the discretion of the delivery driver to determine a final safe location for skip bin placement. When deciding on a final placement of the trailer the driver takes into consideration safety of clients, minimizing incidents and ensuring no public walkways/footpaths are being obstructed. Once the trailer has been placed it CANNOT be moved. If for any reason, we find that it has been moved a $100 fee will be charged to the customer. If for any reason the bin needs to be move please contact East Coast Skip Bins and we will organise for some one to come out and move it as soon as we can.

4: Damages to property or land

East Coast Skip Bins accepts no liability for any property damage above or below ground during delivery or pick up of hire skip bin trailer. It is the customers responsibility to provide information and ensure that the chosen area of placement is safe and suitable for delivery taking into consideration trailer specifications outlined in general terms of hire clause 2; The chosen area MUST be a suitable size and be assessed for hazards. Area must be clear of overhead powerlines and cables, be able to bear the weight of the fully loaded skip trailer and the vehicle towing said trailer. East Coast Skip Bins will not be liable for damage caused to land or any property, including but not limited to grass, driveways, personal property, cars or automobiles, gardens and fencing, garages, carports, houses, kerbs, or other structures.

5: Skip Bin Usage Restrictions

Whilst the skip bin is in the possession of the customer during the hire period the customer is prohibited from:

• Placing any prohibited waste types in the skip bin or allowing others to do so also.
• Lighting Fires/burning any materials in the skip bin or allowing others to do so
• Filling the skip bin above its allowable weight limits/recommended capacity. Or in an instance where the lid cannot close.
• Using the skip bin in any manner that endangers any person, animal, general public or property of any kind. Or allowing any other person to use the skip bin in such ways.

6: Customers responsibility in regard to Rubbish Disposal

During booking the customer must inform East Coast Skip Bins of the type of Rubbish they wish to dispose of as some items will incur an extra fee (outlined in Waste Specifics)

7: Cancellation and Refund Policy

If the customer wishes to cancel their booking, it must be done in writing directly to “East Coast Skip Bins” via email eastcoastskipbins@gmail.com within certain time frames outlined below.

• If the customer cancels their booking (3) Business days or more prior to their booking date the customer will be refunded hire monies paid to East Coast Skip Bins minus booking fees.
• If the customer cancels their booking less than (3) Business days but greater than (1) Business Day, the customer will be refunded hire monies paid to East Coast Skip Bins minus a cancellation fee of 15% and Booking fees.
• If the Customer cancels on the delivery booking day, the customer will be refunded hire moneys paid minus a 50% of the total hire price cancellation fee and any booking fees.

7:1: Acknowledgment of Customer:
The customer acknowledges, understands, and agrees to adhere to any/all terms outline in East Coast Skip Bins cancellation policy. Including cancellation fees stated in 7 (a,b,c). The customer accepts that they will not be entitled to a refund of any fees and charges paid whereby the customer has not provided adequate notice of cancellation.

7:2: Cancellation by East Coast Skip Bins:
East Coast Skip Bins may cancel any booking at any time leading up to or on the booking date in circumstances where they are unable to deliver or supplying of the hired skip. In the instant where East Coast Mobile Skips must cancel a booking a full refund of any/all fees will be refunded.

8: Customer Obligations

The customer understands and agrees to all information outlined in East Coast Skip Bins terms & conditions policy. In addition, the customer agrees to adhere to the following

• During the hire period the skip bin must be used in a safe, responsible manner always
• The customer agrees to bear the full responsibility, liability and cost for ANY loss, damage to, or destruction of the skip bin
• The customer agrees to have the skip bin ready for collection on the agreed collection date
• During the hire period the Skip Bin remains the property of “East Coast Skip Bins” ownership is NEVER transferred.
• The customer agrees that only approved waste types can be placed into our skip bins and any dangerous waste materials found will incur a fee

9: Acceptable Waste Types

General Rubbish Including- Furniture, Timer, Clothes, Household items, Office Materials & Electrical Goods.

Building Rubbish- Plaster, Timber, Carpet, Steel, Building Rubbish

Green Waste- Gardening Waste, Trees

10: Items that will incur an extra fee

Tires- Car, 4×4 & Motorcycle tires- $20 per tire

Truck Tires– $30 per Tire

Mattresses- $100 Per Mattress (Ute removal, no skip space used)

East Coast Skip Bins also offers a fortnightly large rubbish collection. Simply call and book in your items and we will let you know of our next collection date.

11: Prohibited Waste

Under no circumstances do we allow any dangerous materials to be discarded in our Skip Bins. These dangerous materials include but are not limited to materials like ASBESTOS, CHEMICALS, POISONS, BATTERIES, PAINT, FOOD & BIOLOGIACL WASTE, MEDICAL WASTE, LIQUIDS, RADIOACTIVE WASTE, GAS BOTTLES, SPRAY CANS. If any of these materials are found in our bins at the time of collection, they will be removed, and an extra charge will be applied to the customer. If these materials are found in the skip after they have been tipped the customer will face heavy decontamination charges payable immediately.

12. Skip Bin Load Limit

East Coast Skip Bins has 2 price options for different waste removal needs, these options are from 0 – 500 kg, and 500kg – 1,000 kg (1-tonne Maximum Capacity) and is specified at the time of booking. Once filled, all skip bins are weighed at the dump on a weighbridge. Overweight skips will result in a fine of $35.00 per 100 kgs. And a separate invoice will be sent.

 

13. Full List of Terms and Conditions

By placing an order with East Coast Skip Bin for the hire of one of our skip bins, the hirer agrees to the following terms and conditions as part of the Rental Agreement. It is crucial that hirers use East Coast Skip Bins carefully. If you have any queries, phone us at 1300 ECSKIP (1300 327 547) after carefully reading them.

 

14. To the Customer

The terms and conditions are part of this legally binding agreement, including hirer’s disclaimer from all liability for injury and damage.

14.1 The following are considered hazardous waste and are not acceptable for disposal in the East Coast Skip Bin:

1. 1. Radioactive waste
   2. Medical waste.
   3. Grease trap waste
   4. Contaminated soil
   5. Paint
   6. Batteries
   7. Used oil filters
   8. Containers filled with oil
   9. Acids
   10. Asbestos
       It should be noted that asbestos is a highly hazardous chemical. Incorrect asbestos disposal may result in criminal charges. The hirer is responsible for any asbestos discovered in the trailer skip. The expense of asbestos disposal is the hirer’s responsibility and might run into the hundreds of dollars.East Cast Skip Bin’s are designed to hold common rubbish. They are not designed to handle heavy debris such as concrete, mud, bricks, boulders, rubble, sand, soil, tiles, or anything else of the sort. This type of heavy rubbish must not exceed 5 wheelbarrow loads per bin.

14.2 East Coast Skip Bins has 2 price options for different waste removal needs, these options are from 0 – 500 kg, and 500kg – 1,000 kg (1-tonne Maximum Capacity) and is specified at the time of booking. 14.3 In extreme circumstances of excess weight, we may be unable to transport the trailer due to road authority restrictions, or the skip bin may be too heavy to empty. In this case, the hirer will be charged for an extra bin (or bins) and will be responsible for segregating the waste into various bins in order to meet the weight restriction.

14.4 The hirer is liable for any fines imposed on the trailer skip bin while it is in his or her possession. Fines for illegally parking the trailer bin or overloading the trailer are two examples.

14.5 The replacement value of the trailer hired is $8,500. The hirer agrees to this value in the signing of the hire agreement.

14.6 All risks as stipulated in the terms and conditions of hire pass to the hirer on the signing of the hire agreement and when the trailer leaves the physical possession and control of East Coast Skip Bins . The hirer indemnifies East Coast Skip Bins and shall keep it and its officers and employees indemnified in respect of:

1. 1. Any loss or damage (including legal costs on a solicitor and own client basis) from any act, omission, or breach of this agreement or any law or regulation by the hirer, its officers, or employees or any person permitted by the the hirer to use the trailer,
   2. Any claims by any person for injury to person or property, including consequential loss, arising from the use of the trailer.

14.7 The owner (East Coast Skip Bins) shall not be liable for any injuries caused to the hirer, their agents or any third parties arising out of the use of the trailer during the hire period.

14.8 The owner (East Coast Skip Bins) shall not be liable for any consequential losses arising out of the use of the trailer or inability to use the trailer.

14.9 The hirer is liable if the trailer is stolen, damaged or involved in an accident during the period of hire, whilst the trailer is both attached and detached from any vehicle. Any items carried or stored in the trailer are entirely the hirer’s responsibility, as are any accidents arising from the use of the trailer or any injury sustained to the hirer or any other third party.

14.10 The hirer agrees to pay East Coast Skip Bins in full the value of the trailer should it be stolen, lost, destroyed, confiscated and/or impounded. This amount shall become payable at the end of the hire period. East Coast Skip Bins reserves the right to charge the full daily hire rate to the hirer until such monies are paid in full.

14.11 The hirer shall notify East Coast Skip Bins if the equipment requires any repairs or adjustments, and shall not authorise any individual to carry out any repairs or adjustments without East Coast Skip Bins prior consent. The hirer uses the trailer at his or her own risk, and the manufacturer’s stated tolerances must not be exceeded

14.12 The hirer must inspect the trailer and agree that it is in functioning order. The hirer acknowledges that the rental equipment was received in excellent functioning order and that it will be returned in the same order, with normal wear and tear accepted.

14.13 The hirer further agrees that if the trailer is not returned to East Coast Skip Bins at the conclusion of the rental period, copies of the documents provided to East Coast Skip Bins for identification reasons may be forwarded to the Police to aid in their investigations. If the trailer is not returned at the conclusion of the hiring period, it will be reported to the police as stolen, and the hirer will be considered to be unlawfully in possession of the trailer from the time the signed hire agreement expires.

14.14 The hirer also agrees to pay solicitors fees and court costs involved on behalf of East Coast Skip Bins in their having to take any legal action to recover either the trailer, the value of the trailer or repair costs through the hirer not complying with the terms and conditions of hire.

14.15 If any payments are not made upon collection of the skip, the contents will be returned to the hirer on their property.

14.16 East Coast Skip Bins may serve notices at the address stated in the agreement.

15. Late Payment Fees

All hirers MUST pay by the agreed payment terms at the time of the booking.

East Coast Skip Bins reserves the right to charge a credit card previously used for any outstanding amounts without prior notice.

East Coast Skip Bins reserves the right to charge an interest fee and administration fee on any outstanding amounts.

The interest rate is 5% of the total amount outstanding charged weekly plus a $50 administration charge.

The hirer agrees that any costs incurred in the collection of outstanding amounts including the fees of a debt collection agency and all associated court and legal costs are at the expense of the hirer.
